These Terms of Service ("Terms") govern your access to and use of Noqu-I-Sema (the "Platform"), operated by Reef Monkey Studios ("we," "us," or "our"). By creating an account or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use Noqu-I-Sema.
You must be at least 18 years old to register an account on Noqu-I-Sema. By registering, you represent that you meet this requirement and that the information you provide during registration is accurate and truthful. Profiles for minors or deceased family members may be added to a family tree by an adult relative, but a minor may not hold their own account.
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at bula@noqusema.com if you suspect unauthorised use of your account. We are not liable for any loss arising from your failure to safeguard your login credentials.
Registration requires payment of a one-time Account Activation Fee, shown in Fijian dollars (FJD) and United States dollars (USD) at checkout, payable via MPaisa or PayPal. The fee may be waived in full or in part by entering a valid coupon code.
The Account Activation Fee is non-refundable. It is charged to offset the costs of processing your registration and activating your account, and is earned by us in full at the time your account is successfully activated, regardless of your subsequent use of the Platform. This non-refundable fee is separate from, and not affected by, any donations you may later make to fundraisers, which are addressed in Section 7.
Payment for the Account Activation Fee is processed through Fulcrum Payment Gateway, a payment processing service operated by Fulcrum Pte Limited, a company registered in the Republic of Fiji, of which Reef Monkey Studios is a service.
You retain ownership of the content you submit to Noqu-I-Sema, including photos, biographical text, and family tree and relationship data ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and share Your Content with other users as necessary to operate the Platform and in accordance with your privacy settings and this Terms of Service.
You are solely responsible for Your Content, including information you add about relatives or other individuals who are not registered users. You represent that you have a good-faith, reasonable basis for adding such information (for example, as a family member recording family history) and that it is accurate to the best of your knowledge. You must not add content that is knowingly false, defamatory, or that violates the rights or privacy of any person. We reserve the right, but not the obligation, to review, edit, or remove any content that violates these Terms.

We may investigate suspected violations and take action as described in Section 9, including removing content or suspending or terminating accounts.
Village chatrooms are restricted to members associated with that village. Direct messages are subject to each recipient's privacy settings. You are responsible for your own conduct in chat and at any events organised, listed, or RSVP'd to through the Platform. Noqu-I-Sema is a tool for coordinating community events; we are not the organiser of user-created events and are not responsible for their planning, safety, or execution.
Users may create fundraiser listings, subject to administrator approval, and other users may donate to them through the Platform's payment integrations. Noqu-I-Sema acts solely as a facilitator connecting fundraiser organisers with donors and processing payments through third-party gateways; we do not guarantee the legitimacy, purpose, or use of funds raised by any fundraiser organiser, though we reserve the right to review, pause, or remove any fundraiser at our discretion. Donations are voluntary and, once made, are generally non-refundable except where required by law or at the discretion of the fundraiser organiser; this is distinct from, and does not affect, the non-refundable Account Activation Fee described in Section 3.
The Noqu-I-Sema name, logo, look and feel, and underlying software are the property of Reef Monkey Studios, and are protected by applicable intellectual property laws. Except for Your Content, nothing in these Terms grants you any right to use our trademarks, branding, or software.
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or created risk or possible legal exposure for us or other users. You may deactivate your account at any time by contacting us. Sections of these Terms that by their nature should survive termination (including Sections 3, 8, 10, 11, 12 and 13) will survive.
The Platform is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that family tree, village, or other user-submitted information is accurate, complete, or up to date. Genealogical and community data on the Platform is contributed by users and reflects their own knowledge and records, not independently verified facts.
To the maximum extent permitted by applicable law, Reef Monkey Studios and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from or related to your use of the Platform, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or your use of the Platform will not exceed the total Account Activation Fee actually paid by you in the twelve months preceding the claim.
You agree to indemnify and hold harmless Reef Monkey Studios and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, Your Content, or your violation of these Terms or of any rights of a third party.
These Terms are governed by, and construed in accordance with, the laws of the Republic of Fiji, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Platform will be subject to the exclusive jurisdiction of the courts of Fiji.
We may revise these Terms from time to time. We will update the effective date at the top of this page when we do, and will communicate material changes through the Platform or by email where appropriate. Your continued use of Noqu-I-Sema after a change takes effect constitutes acceptance of the revised Terms.
